This policy applies to the purchase of advertising packages and paid services on newkey.pro and NewKey.co.il. Paid services are intended exclusively for businesses, companies and parties acting in a business or professional capacity. By making a purchase, the advertiser represents that the engagement is for business purposes and not for personal, household or family use.
NewKey services are digital services and may include advertising, project presentation, use of the platform, management of information and inquiries, and related services. No physical product is supplied and no shipment is made.
The service is deemed to have commenced at the earliest of payment approval, package activation, enabling account features, allocation of resources or commencement of work on the service.
Actual publication or presentation of a project may be subject to submission of information and materials, their review and compliance with NewKey requirements. A delay caused by the customer does not postpone the start of the service period and does not entitle the customer to a refund.
Package details, price and billing frequency will be shown before payment. A one-time package ends at the end of the specified period, while a monthly or annual package renews automatically for an additional period unless the advertiser cancels it before the next billing date. The advertiser is solely responsible for monitoring renewal dates and cancelling renewals. NewKey may send reminders from time to time but does not undertake to do so.
For a renewing package, the payment method will be charged at the start of each additional period at the package price and frequency presented at purchase or as subsequently updated in accordance with the Terms of Use and applicable law. Failure to use the service, failure to sign in to the account, or failure to publish a project for a reason attributable to the customer does not cancel automatic renewal.
Self-service cancellation in the personal area: the advertiser may cancel automatic renewal at any time before the next billing date, independently and directly through the personal area on the Website only. The cancellation takes effect immediately and prevents future charges.
Cancelling renewal does not interrupt the current advertising period; the service remains fully active until the end of the period already paid for.
Separate management: each advertising package and each project is managed separately. Cancelling renewal for one package does not cancel other packages or projects in the account.
The service begins immediately upon payment approval. Accordingly, no full or partial refund will be provided for an advertising period that has already been charged. Cancelling automatic renewal prevents future charges only and does not apply retroactively. Removing an advertisement or discontinuing publication at the advertiser’s initiative before the end of the period does not entitle the advertiser to a refund, subject to any mandatory law that cannot be waived.
NewKey reserves the right, at its discretion, to immediately restrict, suspend or discontinue services and/or remove content due to non-payment, breach of the Terms of Use, provision of misleading information, publication of prohibited or unlawful content, harm to the Website or a third party, suspected fraud, a security risk or a legal requirement.
Taking such action in these circumstances does not entitle the customer to any refund, credit or compensation and does not limit NewKey’s right to any other remedy available under law.
The services and Website are provided "AS-IS" and on an "AS-AVAILABLE" basis. NewKey makes reasonable efforts to maintain the proper operation and availability of the Website but does not guarantee uninterrupted operation or freedom from delays, downtime, hardware or software failures, cyberattacks or damage arising from third parties, including communications, cloud and payment providers.
Downtime, unavailability or a technical malfunction of the Website, for any reason, does not constitute grounds for cancellation of the transaction and does not entitle the advertiser to a full or partial refund.
In the event of a continuous and material system outage that completely prevents advertisements from being displayed, NewKey may, at its sole discretion, extend the advertising period by a period equal to the duration of the outage. Such an extension will be the advertiser’s sole and exclusive remedy.
NewKey and parties acting on its behalf will not be liable for any direct, indirect, consequential or special damage, including loss of profits, loss of transactions, damage to reputation or loss of information, arising from disruption, malfunction or unavailability of the services.
If an automatic renewal charge is not approved, the advertisement will move to the free plan and the features of the paid package will be discontinued. Once payment is settled, the advertisement will return to the purchased package and its included features. The new billing period begins on the date the new payment is approved.
The system does not include a mechanism for upgrading, offsetting or downgrading active packages.
An advertiser choosing a different plan makes a completely new and independent purchase at the full price of the selected package, and a new advertising period begins when that payment is approved.
When a new package is purchased for the same project, the previous package ends and becomes irrelevant. For the avoidance of doubt, no full, partial or prorated refund, credit or offset will be provided for the remaining period of the previous package, and payments made for it will not be credited toward the new package in any way.
NewKey may update this policy from time to time. The updated version will be published on the Website and will apply from the date of publication or to future renewal periods, as applicable and subject to law.
If this policy is translated into another language or there is a conflict between versions, the Hebrew version will prevail.
